  1. I have my DT this friday 9am....I am in the same position as you so will let you guys know how I get on. They are greedy bastards. He has almost tripled his request in his formal complaint and has now gone and brought the replacement/upgrade parts for the car and is trying too get me too reimburse him for them as well??? I am just turning up stating I sold the car too the best of my knowledge his mates took it for a 45 min test drive and then he brought it. I can't afford too pay him if I loose so fingers crossed he gets nowhere otherwise I might just say ok if you aren't happy with it I will buy it back for what I sold it too you for and take out a loan....

  2. Yup I will reiterate what others have said. DONT OFFER THAT BASTARD ANYTHING, I posted the other topic a couple months ago, I to tried to be a GC picked him up from the airport etc. He said their were a few niggles so I offered to pay a little bit of compensation out of good will now he is trying to use that against me in small claims..... I will fill everyone in on the result in a couple months but long story short he wants over a 1/3 of the purchase price in compensation now so If I loose I am thinking I will try buy it back ..... So from my experience tell him to piss off and leave it at that there is a certain type of person that will go out of their way to make their problem someone else's and they guy fits the bill. Cease any further contact!

  3. Yea I will try and respond my case via email and hopefully that resolves it before tribunal but we will see.... I will try and recover phone logs etc if it goes to tribunal but to be honest it is such a pain in the arse so fingers crossed it doesn't make it that far!

  4. Exactly how can I trust his word that he hasn't thrashed it! I have politely told him to piss off and he is still threatening DT I would have also assumed it was vehicle disputes but they don't deal with private sale. I will let you guys know how I get on! From my understanding I will receive a letter in the mail whereby I can reply with the signed contract stating I sold it and portrayed it to the best of my knowledge and he was happy at the time of purchase. I hope he is bluffing as this he said she said shit is extremely tiring and to be honest he is just a whinging pain in the arse.

  5. Great, Thanks guys that gives me a little more confidence if he does take me to DT. I was willing to come to a compromise but he is now demanding I show proof of oil changes etc (which I stated had been done but have no proof is this an issue?) 

    It seems to me like he is trying it on but you know what its like when someone keeps hounding you and you want to move on with life and enjoy my new wheels.

     

    Again that sales and purchase receipt is a life saver so I guess I just send a copy of that to the DT and outline that I described the car to the best of my knowledge and fingers crossed that is the end of it!

  6. Thanks JoKer that is the form I used. Yup complaining gearbox has issues and some dash lights have come on. (I specifically told hime to drive the car to ensure no dash lights are on when he brought it). I struggle to see how I could have foreseen these issues his whole argument is based on the fact that I had to have been aware of it.... I described the vehicle the best and most honest way I could and it has now become an issue that I have to deal with. I understand his point but if that was the case would't we  all be in smalls claims court as no second hand car is perfect?

    Hopefully I am in the right forum.

    Sold my car almost a month ago let the guy test drive it etc he was happy. Signed the sales and purchase agreement that I printed off this site (thanks whoever mocked that up).

    Now the guy is complaining it need repair and is threatening to take me to small claims if I don't pay?

    I sold the car AIWI and was honest in my explanation on the car and it didn't give me any issues when I owned it. I am just after confirmation that I am within my rights to refuse and If he takes me to small claims he won't win. He is accusing me of deception and claiming I knew of the faults before I sold it. Obviously this is something no one wants to deal with and would like some other opinions!
