Reverse lights for WOF?

My van is just about due for a WOF and the reverse lights dont go, I havent really looked at them as not a problem but do you need them for a wof. And could I hook them up to a switch if theres something wrong with whatever makes them go when put into reverse.

The previous owner got it a wof with them as is but think it was a bit dodgy as is a few things that needed doing even just after it got a WOF.

When I was doing WOF's they needed to either both go or neither go.. Weird rule I know..

I have a funny feeling now that if they are fitted they have to go so if you remove them then you shouldn't have a problem.

Though I guess this wouldn't work if the reverse lights are part of the taillights..

Applicable legislation

• Land Transport Rule: Vehicle Lighting 2004

Permitted equipment

1. One or two reversing lamps fitted at the rear of the vehicle.

2. A retrofitted pair of reversing lamps must be symmetrically mounted as far towards each side of the vehicle as practicable.

Condition

3. A reversing lamp must be in good condition.

Performance

4. A reversing lamp must operate in a way that is appropriate for the lamp and the vehicle.

5. A reversing lamp, when operated, must emit a diffuse light or a dipped beam of light that is substantially white (Note 3).

6. A reversing lamp must emit a steady light.

7. A reversing lamp may operate only when the reverse gear is engaged or the headlamps are turned off.

8. Where a reversing lamp comprises an array of light sources (eg LEDs), at least 75% of these must operate.

Modifications

9. A reversing lamp that is affected by a modification:

a) must meet equipment, condition and performance requirements, and

B) does not require LVV specialist certification.

Note 2 A reversing lamp that does not comply with condition and performance requirements must be made to comply or be disabled so that it does not emit a light.

Bump. Saw a conversation on fb today where a couple of wof inspectors say they won't pass a car that doesn't have reverse lights. It's been a decade have the rules changed?

Please report their names so they can have corrective training :)

My wife was failed years ago because only one of two fitted reverse lights worked. We were told "if its there it must work", much like fog lamps. 

But saying that, I have also had cars pass where neither of the reverse lights have worked (dodgy inhibitor switch).
